Terms of Service

These Terms of Service (“Terms”) govern your use of Fanthem (“Fanthem,” “we,” “us”), including fanthem.fm and the sign-up pages we host for artists (the “Service”). By using the Service — whether you’re an artist building a list or a fan joining one — you agree to these Terms. If you don’t agree, please don’t use the Service.
Eligibility and your account
- You must be at least 18 years old (or the age of majority where you live) to create an artist account, and at least 13 to join a list as a fan.
- You agree to provide accurate information and to keep it current.
- If you create an account, you’re responsible for keeping your credentials secure and for all activity under your account. Tell us promptly if you suspect unauthorized use.
The service
Fanthem lets artists and creators collect and manage a list of fans, and lets fans join those lists and receive updates. We may add, change, or remove features over time.
For fans
- When you join an artist’s list, you agree to receive messages from that artist through Fanthem. You can leave any list at any time — unsubscribe from an email or reply STOP to a text.
- Provide accurate contact details, and only sign up with a phone number or email address you’re entitled to use.
For artists
- You’re responsible for the messages you send and for complying with applicable laws, including anti-spam and consent rules (such as CAN-SPAM, TCPA, and GDPR). Only contact fans who have opted in.
- You must honor opt-out requests promptly and must not use the Service to send unlawful, deceptive, harassing, or infringing content.
- You represent that you have all rights and consents needed to contact the fans you collect, and that your use of their data complies with applicable law.
Fees and billing
Some parts of the Service may be offered for a fee. If you purchase a paid plan, the following terms apply:
- You agree to pay the fees listed for the plan you choose, plus any applicable taxes. Prices are shown at the point of purchase.
- Paid plans are billed in advance and, unless stated otherwise, renew automatically each billing period until you cancel. Payments are processed by our third-party payment provider; by purchasing, you authorize us and that provider to charge your payment method.
- We may change prices or plan features. We’ll give reasonable notice of material changes, and any change takes effect on your next billing period.
- If a payment fails or is reversed, we may suspend or downgrade paid features until it’s resolved.
Cancellation and refunds
You can cancel a paid plan at any time; cancellation takes effect at the end of your current billing period, and you’ll keep paid features until then. Except where required by law, fees already paid are non-refundable, and we don’t provide partial refunds for unused time. If you believe you were charged in error, contact us and we’ll look into it.
Acceptable use
You agree not to:
- Use the Service to send spam or to message people without consent.
- Upload unlawful, infringing, or harmful content.
- Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
- Misrepresent your identity or impersonate others.
We may suspend or terminate access that violates these Terms or that we reasonably believe is harmful to fans, artists, or the Service.
Your representations and warranties
By using the Service, you represent and warrant that:
- You have the authority to agree to these Terms (and, if you’re acting for an organization, to bind it).
- The content and messages you send don’t infringe anyone’s rights, and you have the consents needed to contact the fans you collect.
- You’ll use the Service in compliance with applicable laws, including messaging, privacy, export, and sanctions laws, and you’re not located in or acting on behalf of a sanctioned country or party.
Messaging, carriers, and third-party services
The Service sends messages over email, SMS, and WhatsApp using third-party providers (such as Twilio and Meta). Message and data rates may apply to texts, depending on your mobile plan, and delivery depends on carriers and platforms we don’t control. Your use of those channels is also subject to the applicable provider’s and carrier’s terms.
Your content
You keep ownership of the content and data you provide. You grant us the limited rights needed to host, process, and deliver it in order to operate the Service.
Our intellectual property
The Service itself — the software, design, and the Fanthem name and logo — belongs to Fanthem and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You may not copy, modify, resell, or create derivative works from the Service except as expressly allowed.
Use of aggregated data
We may generate aggregated and de-identified data from use of the Service — for example, overall sign-up and delivery statistics — and use it to operate, secure, and improve the Service. Aggregated data does not identify you or any individual fan, and we handle personal information as described in our Privacy Policy.
Copyright complaints
We respect intellectual-property rights. If you believe content on the Service infringes your copyright, email team@fanthem.fm with enough detail to identify the work and the material in question, your contact information, and a statement that you have a good-faith belief the use isn’t authorized. We’ll review valid notices, remove infringing material where appropriate, and may terminate accounts of repeat infringers.
Feedback
If you send us ideas or suggestions about the Service, you grant us a perpetual, royalty-free right to use them without obligation to you.
Privacy
Our Privacy Policy explains how we handle personal information and is incorporated into these Terms.
Termination
You may stop using the Service at any time, and artists may close their account by contacting us. We may suspend or terminate access if you breach these Terms or to protect the Service, fans, or other artists. On termination, your right to use the Service ends; sections that by their nature should survive (such as fees owed, disclaimers, limitation of liability, and indemnification) will continue to apply. We’ll handle data after termination as described in our Privacy Policy and data deletion page.
Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We don’t guarantee that the Service will be uninterrupted, error-free, or that messages will always be delivered.
Limitation of liability
To the fullest extent permitted by law, Fanthem will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim (or USD $100 if you haven’t paid us anything).
Indemnification
You agree to indemnify and hold Fanthem harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, the messages or content you send, or your violation of these Terms or of any law or third-party right. This is especially important for artists sending messages: you’re responsible for having the consents and rights your messaging requires.
Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules.
Dispute resolution; arbitration and class-action waiver
Most concerns can be resolved by emailing us first, and we encourage you to reach out before filing a formal dispute. To the extent permitted by law, you and Fanthem agree that disputes relating to the Service will be resolved by binding individual arbitration in the United States, rather than in court, and that each party waives the right to participate in a class or representative action. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms. Nothing here prevents either party from seeking relief in small-claims court where eligible.
General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Fanthem about the Service.
- Severability. If any part is found unenforceable, the rest stays in effect.
- No waiver. Our not enforcing a term isn’t a waiver of it.
- Assignment. You may not transfer these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We aren’t liable for delays or failures caused by events beyond our reasonable control.
- Relationship. You and Fanthem are independent parties; these Terms don’t create any agency, partnership, or employment relationship.
- Notices. We may provide notices through the Service or by email; you can reach us at the address below.
Changes
We may update these Terms from time to time. When we make material changes, we’ll update the “last updated” date above. Your continued use of the Service after changes take effect means you accept the revised Terms.
